GRUPO CA RESORTS, S.A.P.I. DE C.V. (en adelante referida como la “Sociedad”), informa a nuestros estimados clientes, empleados, terceros, consumidores y usuarios lo siguiente:

De conformidad con lo dispuesto por los Artículos 6, 8, 15 y 16 de la Ley Federal de Protección de Datos Personales en Posesión de los Particulares en lo sucesivo denominada como (la “Ley”), se emite el presente Aviso de Privacidad conforme a lo siguiente.

Que en cumplimiento de la Ley así como a nuestros propios lineamientos corporativos creados para asegurar la privacidad de nuestros consumidores o usuarios, los Datos Personales que usted (en adelante el “Titular”), nos proporcione serán identificados dentro de nuestro sistema interno como “Información Confidencial”, en consideración a lo siguiente:

La Sociedad, está comprometida con la transparencia, seguridad y privacidad de los Datos Personales[1] de nuestros, clientes, proveedores y de cualquier tercero.

Cualquier información concerniente a una persona física identificada o identificable, tales como nombre completo, domicilio, fecha de nacimiento, número telefónico, cuenta de correo particular, entre otros estará protegida por la Sociedad.

Dichos Datos Personales pueden ser recabados por la Sociedad cuando el Titular voluntariamente los proporciona a través de cualquier medio, incluyendo sin limitar, presencialmente, por teléfono, correo convencional o electrónico y/o páginas de Internet, a efecto de generar contacto con la Sociedad.

El presente Aviso de Privacidad aplica a todo Dato Personal que sea recabado directamente por la Sociedad ya sea verbal, escrito, o a través de imágenes o sonidos.

Al recopilar y tratar[2] sus Datos Personales, la Sociedad se compromete y obliga a observar y cumplir los principios de licitud, consentimiento, calidad, información, proporcionalidad y responsabilidad previstos en la Ley.

IDENTIDAD Y DOMICILIO DE LA SOCIEDAD

La Sociedad es una sociedad mexicana debidamente constituida y legalmente existente conforme a las leyes de los Estados Unidos Mexicanos, con domicilio para los efectos del presente Aviso de Privacidad el ubicado en:

FINALIDAD

De acuerdo a lo anterior, el presente Aviso de Privacidad tiene como finalidad principal obtener información para iniciar una relación contractual y/o comercial, vinculada con la compra de un bien inmueble destinado a fines residenciales, y se tiene como finalidad secundaria preparar y/o iniciar expedientes o solicitudes; para darle seguimiento a los documentos o acciones vinculadas con la finalidad principal.

Adicionalmente se podrán usar los Datos Personales del Titular para cumplir con la identificación, tecnologías de la información, operación, administración, mercadotecnia, comercialización y otros fines análogos y lícitos, conforme a lo dispuesto por la Ley; para analizar las circunstancias al celebrar convenios o contratos.

Cuando usted como Titular voluntariamente nos proporciona sus Datos Personales, está manifestando su consentimiento respecto al presente Aviso de Privacidad y por consiguiente está autorizando a que la Sociedad recopile, compile, use, transfiera y almacene sus Datos Personales de conformidad con el mismo y con las leyes aplicables; lo que implica que usted entiende el significado y alcance de sus términos.

Usted podrá como Titular revocar su consentimiento en cualquier momento sin que se le atribuyan efectos retroactivos, de conformidad con lo que más adelante se establece.

Con el objeto de dar cumplimiento a lo establecido en el Artículo 16 de la Ley se señala lo siguiente:

DATOS PERSONALES Y DATOS PERSONALES SENSIBLES

La Sociedad ha solicitado y recibido y/o podría solicitar Datos Personales. Dicha información se proporciona en forma voluntaria y gratuita y podría consistir en uno o más datos que de forma enunciativa más no limitativa, misma se pueden llegar a solicitarse y que se describe a continuación:

1. Nombre (Apellido Paterno, Apellido Materno y Nombres).
2. Dirección o Domicilio.
3. Estado Civil
4. Lugar de nacimiento
5. Fecha de nacimiento
6. Nacionalidad.
7. Profesión
8. Teléfono personal, o celular.
9. Dirección de correo electrónico.
10. Clave Única de Registro de Población (CURP).
11. Registro Federal de Contribuyentes (RFC).
12. Números de cuentas bancaria o instituciones financieras o crediticias con las que se encuentre afiliado(a).

La Información referida anteriormente podría ser capturada y corroborada por la Sociedad a través de documentación comprobatoria que se le podrá solicitar al Titular a través de los diversos departamentos operativos y de personal acreditado de la Sociedad, ya sea directamente y de forma personal del mismo Titular, o bien, a través de medios electrónicos, ópticos, sonoros, visuales o por cualquier otra tecnología con la finalidad de dar cumplimiento con múltiples obligaciones de carácter legal y administrativo, así como negociación y generación de relaciones contractuales con sus clientes y proveedores, así como el cumplimiento de sus contribuciones de carácter fiscal y de seguridad social. Todo lo anterior en estricto apego a la legislación vigente en la República Mexicana.

En cuanto a los Datos Personales Sensibles, particularmente podríamos llegar a solicitar sólo en caso de ser necesario, datos respecto a la información financiera o fiscal que esté vinculada con la finalidad principal señalada en el presente Aviso de Privacidad.

Seguridad: Sus Datos Personales automáticamente recibirán la protección suficiente y necesaria para resguardarla como tal, utilizando los más altos estándares de protección administrativa, técnica, física y legal de que disponemos, a fin de evitar daño, pérdida, alteración, destrucción, uso, acceso o tratamiento no autorizado.

Riesgos: No obstante lo indicado en el párrafo anterior y el hecho de que la Sociedad se compromete a hacer su mejor esfuerzo en el cuidado y protección de sus datos personales, usted debe estar consiente sobre el permanente riesgo a que está expuesto cualquier sitio en web y/u otros medios, respecto a intromisiones, destrucciones, extracciones, manipulaciones, etc. de información que pueden ser ejecutados por terceros no autorizados y que ni la Sociedad ni ninguna entidad física ni moral cuenta con la absoluta garantía para evitar dichas acciones, por lo que la Sociedad se deslinda de responsabilidad alguna por acciones emprendidas por dichos terceros que estén fuera del alcance de la Ley.

OPCIONES Y MEDIOS QUE LA SOCIEDAD PONE A SU DISPOSICIÓN PARA LIMITAR EL USO O DIVULGACIÓN DE SUS DATOS PERSONALES

La Sociedad cuenta con las medidas de seguridad, administrativas, técnicas y físicas necesarias e implementadas conforme a sus políticas y procedimientos de seguridad, para asegurar sus Datos Personales contra un uso indebido o ilícito, un acceso no autorizado, o contra la pérdida, alteración, robo o modificación de sus Datos Personales; quedando prohibido su divulgación ilícita y limitando su tratamiento conforme a lo previsto en el presente Aviso de Privacidad y en la legislación aplicable.

MEDIOS PARA EJERCER SUS DERECHOS ARCO

Usted, a partir del 6 de enero de 2012, como titular de los Datos Personales, o en su caso, su representante legal, puede ejercer ante la Sociedad, cualquiera de los derechos respeto al Acceso, Rectificación, Cancelación y Oposición, de su información, también conocidos como derechos ARCO por sus iniciales que contempla el artículo 22 de la Ley y que se explican a continuación, en el entendido que cada uno de estos derechos es independiente entre sí, es decir, no es necesario agotar uno para poder ejercitar alguno de los otros tres:

Acceso. Es la facultad que tiene usted de solicitar a la Sociedad que le informe si en sus Bases de Datos tiene alguno de sus Datos Personales.

Rectificación. Es el derecho que tiene para que se corrijan sus Datos Personales en posesión de la Sociedad.

Cancelación. Es la facultad que tiene usted de solicitar la cancelación de sus Datos Personales en posesión de la Sociedad.

Oposición. Es la facultad que tiene usted de solicitar a la Sociedad que se abstenga de realizar el tratamiento de sus Datos Personales en determinadas situaciones.

Las solicitudes para el ejercicio de sus derechos ARCO, deberán presentarse por escrito a la Sociedad en el domicilio señalado en el presente Aviso de Privacidad, o bien, por medios electrónicos a través de nuestro portal de Internet, (dirección en internet www.voyagevacationclub.com; o en su caso al correo electrónico ([email protected])

En todos los casos favor de confirmar con nosotros, que hemos recibido de manera correcta su solicitud para ejercer sus Derechos ARCO, a fin de evitar problemas de comunicación o dilaciones innecesarias.

La solicitud que usted realice como Titular para ejercer cualquiera de sus derechos ARCO deberá ser por escrito y contener al menos lo siguiente: (i) su nombre completo, correo electrónico y domicilio o medio para recibir comunicaciones; (ii) su identificación o documentos que acrediten su personalidad o la de su representante legal; (iii) la explicación clara y precisa de los Datos Personales a los cuales desea tener acceso, rectificar, cancelar u oponerse; y (iv) fecha estimada de cuándo se proporcionaron los Datos Personales a la Sociedad, y cualquier otro elemento o documento que facilite la localización de sus Datos Personales.

Toda comunicación deberá dirigirse al siguiente Departamento, el cual ha sido designado como responsable para el trámite de solicitudes y fomento a la Protección de Datos Personales, en términos del Artículo 30 de la Ley:

En caso de enviar su solicitud vía correo electrónico, se le recuerda que deberá presentarse posteriormente en el domicilio indicado, a fin de acreditarnos fehacientemente su identidad, por la propia seguridad de sus datos personales.

Usted puede revocar el consentimiento que, en su caso nos haya otorgado para el tratamiento de sus datos personales. Sin embargo, es importante que tenga en cuenta que no en todos los casos podremos atender su solicitud o concluir el uso de forma inmediata, ya que es posible que por alguna obligación legal, o bien por subsistir la relación jurídica, requerimos seguir tratando sus datos personales.

TRANSFERENCIA DE DATOS PERSONALES

La Sociedad podrá transferir sus Datos Personales a las siguientes personas y/o entidades, en el entendido que deberá asegurarse que dichas personas y/o entidades, guarden estricta confidencialidad respecto de la información proporcionada:

1. Las Sociedades controladoras, subsidiarias o afiliadas de la Sociedad en México o en el extranjero;
2. Clientes nacionales o extranjeros a los que la Sociedad presta servicios;
3. Terceros proveedores de servicios y autoridades, para el cumplimiento de las obligaciones comerciales, legales, contables, fiscales, regulatorias o contractuales a cargo de la Sociedad, incluyendo instituciones bancarias, o dependencias gubernamentales, subsidiarias o afiliadas en México o en el extranjero;
4. Terceros con fines de referencias, personales, comerciales, mercadotecnia, tecnologías de la información, operación, administración, comercialización y otros fines análogos y lícitos; y
5. Autoridades, Jueces, Notarios, Corredores Públicos o peritos que por su trabajo necesiten tener acceso a sus datos personales.

Le informamos que, para las transferencias de datos antes indicadas, requerimos obtener su consentimiento con base en los procedimientos aquí señalados, por lo que si usted no manifiesta su negativa de forma expresa dentro del término de 5 (cinco) días hábiles, para dichas transferencias, entenderemos que las transferencias, han sido aceptadas.

GRUPO CA RESORTS, S.A.P.I. DE C.V. (hereinafter referred to as the “Corporation”), notifies our dear customers, employees, third parties, consumers and users as follows:

In accordance with the provisions of Articles 6, 8, 15 and 16 of the Federal Law of Protection of Personal Data in the Possession of Private Individuals, hereinafter referred to as (the “Law”), this Privacy Notice is issued in accordance with the following.

That in compliance with the Law, and with our own corporate guidelines created to ensure privacy of our consumers or users, Personal Data that you (hereinafter the “Holder”) shall provide us must be identified within our internal system as “Confidential Information”, taking into consideration as follows:

The Corporation is committed with transparency, security and privacy of Personal Data[3] of our customers, providers and any third party.

PURPOSE

In accordance with the foregoing, the main purpose of this Privacy Notice is securing information to start a contractual and/or business relationship, associated with the purchase of a real property for residential purposes, and having as second purpose the preparation and/or start of files or applications; to follow up the documents or actions related to the main purpose.

Additionally, the Personal Data of the Holder may be used to comply with the identification, IT, operation, management, marketing, trading and other similar and legal purposes, as set forth in the Law; to analyze the circumstances upon executing agreements or contracts.

You, as Holder, may revoke your consent at any time without this deriving in retroactive effects, as established below.

The Corporation has requested and received, and/or may request, Personal Data. Such information is voluntarily and freely provided and may consist in one or more data that without limitation, may be required and that are described below:

1. Name (Paternal Surname, Maternal Surname and Names).
2. Address or Domicile.
3. Civil Status.
4. Place of birth
5. Date of birth
6. Nationality.
7. Profession
8. Personal telephone or mobile.
9. E-mail Address.
10. Sole Population Registration Code (CURP).
11. Federal Taxpayer’s ID Number (RFC).
12. Numbers of bank accounts or financial or credit institutions of which you are member.

The Information previously referred to may be entered and proved by the Corporation through evidentiary documents that may be required to the Holder through the sundry operating and authorized personnel departments of the Corporation, whether directly and personally of the same Holder [SIC], or else, through electronic, optical, sound, visual means or through any other technology in order to comply with multiple legal and administrative obligations, as well as the negotiation and generation of contractual relationships with your customers and providers, and compliance with your tax and social welfare contributions. All the foregoing in due compliance with the applicable legislation in Mexico.

As regards the Sensitive Personal Data, we may specifically require, only if necessary, data related to the financial or tax information associated with the financial and tax information for the main purpose indicated in this Privacy Notice.

Security: Your Personal Data shall automatically receive sufficient and necessary protection to be safeguarded as such, using the highest administrative, technical, physical and legal protection standards available to us, in order to prevent any damage, loss, alteration, destruction, use, access or unauthorized processing.

Risks: Notwithstanding anything indicated in the foregoing paragraph and the fact that the Corporation agrees to do its best efforts for due care and protection of your personal data, you shall be aware of the permanent risk any website and/or other means are exposed to, in relation to intromissions, destructions, extractions, handling, etc. of information that may be performed by unauthorized third parties and that the Corporation or any individual or legal entity shall not have the absolute guaranty to prevent such actions, therefore, the Corporation shall be released from any liability for any action carried out by such third parties beyond the scope of the Law.

MEANS TO EXERCISE YOUR ARCO RIGHTS

As from January 6, 2012, you, as holder of Personal Data, or, as the case may be, your legal representative, may exercise before the Corporation, any of the rights regarding Access, Rectification, Cancellation and Opposition of your information, also known as ARCO (acronym) rights, as contemplated in Article 22 of the Law, and that are explained below, provided that each of these rights is independent to each other; that is to say, it is not necessary to exhaust one to be able to exercise any other of the remaining three:

Access. The power that you have to request the Corporation to notify you if any of its Databases has any of your Personal Data.

Rectification. Your right to have your Personal Data under possession of the Corporation corrected.

Cancellation. The power you have to require the cancellation of your Personal Data under possession of the Corporation.

Opposition. The power you have to require the Corporation to abstain from processing your Personal Data in certain situations.

The applications to exercise your ARCO rights shall be submitted in writing to the Corporation at the address indicated in this Privacy Notice, or else, through electronic means or on our Internet portal, (website www.voyagevacationclub.com; or, as the case may be, the e-mail address ([email protected])

In any event, please confirm with us that we have correctly received your application to exercise your ARCO Rights, in order to prevent communication problems or unnecessary delays.

The application you submit as Holder to exercise any of your ARCO rights shall be made in writing and include, at least, the following: (i) your full name, e-mail and address or any means to contact you; (ii) your identification or documents evidencing your capacity or that of your legal representative; (iii) a clear and accurate explanation of the Personal Data you wish to have access, rectify, cancel or oppose; and (iv) estimated date of the period whenever the Personal Data were provided to the Corporation, and any other element or document facilitating the location of your Personal Data.

Any communication shall be addressed to the following Department, which has been appointed as person in charge for processing applications and to foster the Protection of Personal Data, under the terms of Article 30 of the Law:

If you send your application by e-mail, we remind you that such application shall be submitted thereafter at the indicated address, so we can unquestionably evidence your identity, for the own security of your personal data.

You may revoke the consent that, as the case may be, had granted to us to process your personal data. However, it is worth having in mind that we shall not be able to serve your application or to immediately terminate the use thereof in all cases, since it is possible that due to any legal obligation, or else, for the survival of the legal relationship, we shall require to keep on processing your personal data.

TRANSFER OF PERSONAL DATA

The Corporation may transfer your Personal Data to the following individuals and/or entities, provided that it makes sure that the foregoing keeps strict confidentiality regarding the information hereby provided:

1. The Holding Companies, subsidiary or affiliated companies of the Corporation in Mexico or abroad;
2. National or foreign customers to which the Corporation provides its services;
3. Third service providers and authorities, to comply with the business, legal, accounting, tax, regulatory or contractual obligations entrusted to the Corporation, including banking institutions or government instrumentalities, subsidiary or affiliated companies in Mexico or abroad;
4. Third parties with reference, personal, business, marketing, IT, operation, management, trading purposes and any other similar and legal purposes; and
5. Authorities, Courts, Notaries Public, Commercial Notaries Public or experts who due to their tasks may require having access to your personal data.

We notify you that in order to transfer the data indicated above, we shall secure your consent based on the procedures herein indicated, therefore, if you fail to indicate your express rejection within the five (5) business days to perform such transfer, we shall understand that such transfers shall have been accepted.

AMENDMENTS TO THE PRIVACY NOTICE

Any amendment to this Privacy Notice shall be indistinctly notified, through notices in the offices of the Corporation, by e-mail or through the internet portals of the Corporation (www.voyagevacationclub.com)
